GENERAL INFORMATION

The HELLENIC NAVY HYDROGRAPHIC SERVICE (HNHS), created the web site hnhs.gr in order to offer information and services to the interested "users". Its use is conditioned by the present Terms and Conditions, which the users are called to read carefully and comply with them. The use of “hnhs.gr” involves unconditional acceptance of the present Terms and Conditions. 

HNHS is eligible to modify whenever, without previous warning, the present Terms and Conditions of Use and undertakes the obligation to inform the present text on each modification or addition. 

In case at which the use of any service of “hnhs.gr” is regulated by more special terms of use, these terms are considered as a total with the present Terms and Conditions of Use. However, in case of conflict, the more special terms of use of each service predominate.

CONTENT – HNHS RESPONSIBILITY

“Hnhs.gr” is being used "as such", without the capability of modifications or other interventions from the user. The HNHS by any means, tries to provide in her web site, safety in use as well as precise, complete, valid, reliable and up to date information. In any case, however, the users recognize and accept that, given the nature and the volume of responsibility of the HNHS, she is not probably in place for controlling totally the content and the safety of web pages and her services. For this reason, the HNHS neither is committed, neither it guarantees, nor it undertakes any type of responsibility in regard to the safety and the content of “hnhs.gr”. Consequently, the users accept that they should evaluate the content and that they are aware of any danger can be caused by the use of this, if their decision is to be based on the correctness, the plenitude, validity and/or the usefulness of any content of the “hnhs.gr”. 

“Hnhs.gr”, refers via links in other web pages, the owners of which have complete (urban and penal) responsibility for the safety, legality and validity of the content of their web pages and services, thus any responsibility of the HNHS is excluded, such as copyrights. Consequently the users are compelled to be arranged with the terms of use of those web pages and to be addressed directly in their owners for anything it may results from the visit and/or use of them.

OBLIGATIONS OF USERS

Except of third person rights (intellectual and other), all the content that each time is contained in “hnhs.gr”, constitutes intellectual property of the HNHS and it is protected from the relative provisions of the Greek, Community and international law. This content is not, totally or partially, subject to trade, copy, modification, reproduction, broadcast, transmit ion or it is distributed with any way from any user. 

The users accept, agree and stipulate that they will make legal and expedient use of the “hnhs.gr”, subject among others in the legislation that concerns the transmission of data from Greece to the European Union member states and third countries. Consequently, the users indicatively and not restrictively agree that they will not make use of the “hnhs.gr” in order to: 

• Transmit or acquire access to content which:
i) violates any third person rights (eg intellectual rights), 
ii) counteracts to the law and the virtuous morals

• Deceive anyone as for the origin of content of the “hnhs.gr”, damage, by any means the fame of HNHS or third person, endanger the safety of the HNHS network, and prevent any user to have access to the “hnhs.gr” or bypass their identity control from the HNHS

•  Install and promote, by anyway, any type of self-appointed or not permitted publicity or not asked from  the recipient electronic messages (spam), chain letters, systems of pyramids and any other form of undesirable promotion of content, as well as to install and promote advertisements without the written consent of the HNHS

• Install, promote and/or allocate content that contains digital viruses or any other digital code, files or applications programmed to interfere, destroy or limit the operation of any software or telecommunications equipment or prevent other users of using “hnhs.gr”

In any case, illegal or opposite to the present Terms of Use, the users are compelled to compensate the HNHS for each positive and negative damage. The not exercise of rights risen from these present Terms by the HNHS, does not involve resignation from her rights.

CODED ACCESS 

For the access in certain services or for the connection to certain web pages, it is probable that specific users’ personal data could be asked aiming at the attribution of relative Passwords. The above data should be always true, precise, valid and complete. The users are in charge for all the action that is held with their own password and they should notify immediately the HNHS for any unauthorized use and for any (even potential) violation of safety. These data are not notified by the HNHS to any third person. The HNHS is not responsible for any harm or damage which by any chance could result from the arbitrary or illegal use of password codes by third persons, and it maintains the right to ask the payment of compensation from the user, in case where it suffers any type damage from arbitrary or illegal use of passwords. The HNHS is eligible to deny the awarding of a password or to cancel a granted code or to terminate the benefit of these services to the user and to deny current or future use of “hnhs.gr”, in case of violation of Terms of Use.

NETWORK AVAILABILITY AND SAFETY

The HNHS overwhelms legitimate efforts for the maintenance and the availability of the “hnhs.gr”. The users, however, accept that the HNHS is eligible to modify and/or temporarily or permanently interrupt total or portion of it with and/or without warning to the users, since the availability can be influenced from the equipment of users, other networks of communications, the big number of individuals that simultaneously make use of the “hnhs.gr” or from other causes. Consequently the HNHS does not carry any responsibility for any type of damage (positive, negative, from negligence or other) emanating from the use of the “hnhs.gr” or the inaccessibility to this, the pause of its total or portions of it, the delay, not delivery, interruption or bad quality of reception of its services or loss of their content, the existence of all kinds of errors. In every case the HNHS maintains the right to interrupt provisionally or finally the operation of all or portion of the “hnhs.gr” for reasons of maintenance or upgrade or for any other reason.

Even if the HNHS overwhelms each possible effort of protection of the “hnhs.gr” from digital viruses, it cannot guarantee that it will never be offended by viruses.  Consequently each user should attend his own protection (use of antivirus, virus scanner or other systems of protection) before the use of the “hnhs.gr” or the storage of information, software or its content to his personal computer.

PERSONAL DATA 

The HNHS can keep track and process users’ personal data, which will come to  her knowledge, via “hnhs.gr” and its services. The user maintains the rights of articles 11 and 13 of law n.2472/1997. The HNHS neither reveals nor publishes users’ personal data.

The HNHS does not carry, against the users, any responsibility for by any chance escape of their personal data, through the pages of “hnhs.gr”, its products and services. 

APPLICABLE RIGHT – VENUE 

The present Terms and Conditions of Use and every modification are conditioned by the Greek Legislation. For each difference that by any chance results from the present convention responsible are the courts of Athens.
